Terms and Conditions
Please note all bookings made are subject to our terms and conditions:
1) Booking information - Bookings are confirmed by email, payment or deposit or a signed registration form through our chosen booking software. Once a booking has been made, it is subject to our terms and conditions.
2) Consent - All children under 18 require parental consent to participate in Edusports activities. It is the parents/guardian's responsibility to have the relevant information completed prior to their visit. This should be completed upon registration. For those under the age of 18, this must be the legal parent/guardian. If the participant is over 18, they will still be required to fill out the Emergency Contact information and any other questions which are required. We (Edusports) require a copy of a list of all participants who have taken part within our activities, along with any medical information/ other information. Without this information, participants will not be able to be included on our Public Liability Insurance. The forms must be completed and returned before the commencement date for the chosen activity. Failure to complete and return these forms on time may result in participants being excluded from activity without refund. This information should be completed on our registration form via our booking system.
3) Cancellation – If the session is cancelled within one month of the planned activity, the full amount due for the session is required to be paid. If we can fill the space before the course takes place, we will provide you with a credit, minus £10 and any other associated fees to your booking, which have been incurred. If we cannot fill the course place, the full amount for the course will require to be paid. If it is cancelled before 1 month, we reserve the right to charge £10, plus any associated booking fees which have been incurred of the course fee as an admin charge/ to cover lost fees. If we cancel the course, we will offer you an alternative session to equal or higher value.
4) Force Majeure - If, due to Force Majeure we are unable to fulfil our contract with you, you will not be due compensation or a refund. This relates to extremely unusual or unforeseeable circumstances beyond our control which generally affect us all. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, extreme weather conditions which make normal operations impossible to continue or dangerous. Edusports shall be entitled to a reasonable extension of its obligations.
5) Data protection – We have measures in place to protect the personal booking information held by us. The contact details provided, will only be used to fulfil our contract with you. Any personal information provided about individuals will only be used to allow Edusports to provide the promised service to our normal high standards.
6) Payment - Payment can be made online or details will be given by invoice. Full payment for the event or activity is due to be cleared before the event. For residentials / specific activity dates, we may agree specific timescales for payments due to us needing to pay out for other activities – this will be discussed on a case by case basis. If payment is not received before the event, you may be refused to participate. Payment can be made in different ways. This could be cash, bank transfer, card payment online or childcare vouchers. Unless agreement has been received, we will not accept cheques as a method of payment. If no payment has been received, you will be invoiced with a surcharge of £10 per booking if this is received after the deadline. Edusports has the right to wave the late payment charge. No booking shall be confirmed until payment has been received.
7) Additional expenses – Any additional expenses or fees resulting from any changes made by the Client, that have not been quoted in the agreed project but subsequently incurred by Edusports, will be invoiced separately after the event.
8) Expectation - All visitors are expected to take full responsibility for their personal behaviour. If participants are making the session unsafe for themselves or other participants, Edusports reserves the right to remove them from the session. Clients/participants must show respect to equipment / vehicles / buildings / other clients / neighbours / staff / centre rules – Abuse or causing distress to others or loss/damage due to negligence will result in repair/full replacement costs. This may also lead to exclusion from activities / accommodation/courses without refund. The decision of the Management Team at Edusports is final.
9) Insurance – In the unlikely event that it is needed, Edusports holds full public liability insurance. You may wish to consider arranging your own cancellation and / or personal accident insurance to fully ensure you're covered.
10) Medical – Edusports requires details of any medication or medical condition that may affect your safety during activities. Please make the Instructors aware of this on arrival. It is your responsibility to ensure that you bring any required medication. Clients must inform us prior to the event of any medical condition/illness/disability (including medication which may affect their performance) so we can discuss your needs and make appropriate arrangements. Failure to do this may result in exclusion from the activity.
11) Liability – All personal items are always the client’s own responsibility. Participants are advised not to bring any valuables. Edusports, cannot take responsibility for any property, loss, theft, injury or damage to personal vehicles, contents fittings or accessories. In the event of a breach of this contract by Edusports, we shall not be liable for any loss, damage cost or expense arising out of the breach which was not reasonably foreseeable at the date the contract is made, except in respect of death or personal injury resulting from any act or omission on the part of Edusports. Edusports will only be liable for loss or damage caused by the proven negligence or default of the company or its employees in performing their obligations under this agreement.
12) Safety – Please note that safety is paramount for all our activities. We aim to provide activities that are safe, enjoyable and fun for all participants. Alcohol or illicit drug use is not permitted prior or during activities. Participants will not be allowed to join in, if in the opinion of the Instructor in charge, they are under the influence or alcohol or drugs. Suspicion will warrant exclusion from the activity session due to health and safety concerns.
Activity Information
Assumed Risk Sport - Whilst every care will be taken over your activity sessions, our sports are involved in sports that carry assumed risk. Participants should be aware of and accept these risks and be responsible for their own actions and involvement in the sport. If you are concerned, you should speak to a member of the Instructor Team. This could include death.
Service and feedback - We want you to enjoy your experience in the outdoors to its fullest. If you are dissatisfied with any aspect of the service provided by Edusports, please inform us as soon as possible, so we can take appropriate action.
Weather conditions - Should weather conditions become unsuitable Edusports may, if conditions are unsafe, may alter or suspend the activities at the centre’s discretion for the safety of the clients. If this is necessary, as much notice as possible will be given.
